Welcome! Thank you for selecting Selkirk Lake Mobile Home Park as your home. In order to protect your investment and enhance your enjoyment of living in the park, the following rules have been established. Please read and fully understand each rule contained herein so as to prevent any misunderstandings in the future. THESE RULES AND REGULATIONS WILL BE ENFORCED. We have no normal office hours; you may call at any time.

MANAGEMENT APPROVAL
All prospective adult residents and occupants must complete a RENTAL APPLICATION and be approved. Management has the right to reject tenancy due to false or misleading statements on the RENTAL APPLICATION. Management must approve all occupants of your home, Number of residents in said home shall not exceed (1) person for each 250 square feet of floor area, exclusive of porches and decks. The home shall be for owner occupied residential use only. No renting or subleasing of the home is allowed at anytime. One family unit per home. A family unit consists of 2 married adults (both names on lease) and 2 children (under age 18).
AMENDMENTS
From time to time, rules may be changed or additional rules may be added. Implementation, a thirty-day (30) written notice of the proposed amendment will be forwarded to every resident. Any new rule or regulations will be considere4 a part of the RULES AND REGULATIONS set forth herein and will be enforced accordingly. New or altered rules will be effective thirty (30) days after posting and delivery.
ENFORCEMENT OF RULES AND REGULATIONS
A major prerequisite for admittance to this mobile home community is that the prospective resident be informed of each RULE AND REGULATION. Prior to admission to this community, each resident must sign an acknowledgement that they have received and read a copy of the rules and regulations. Every effort will be made by management to insure that the rules and regulations are enforced and that your safety and comfort are not disturbed. Observance of community rules and regulations by guests is the responsibility of the resident. Your cooperation is absolutely essential in enforcing these rules. All persons coming into your home after the initial occupancy must also complete a rental application, be approved, and sign as acknowledgement that they have received and read a copy of the rules and regulations and will comply with them. Anyone residing in your home thirty (30) days or more shall be considered a resident in violation and subject to removal if not approved.
NOTICE OF RULE VIOLATION
Management will contact residents who violate a regulation by means of a personal visit, a telephone call, and/or a NOTICE OF RULE VIOLATION will be forwarded. It is expected that all residents will correct the violation within the amount of time noted on the violation notice. Please note that your total adherence is absolutely essential to provide you and your neighbor a peaceful surrounding. REPEATED RULES VIOLATIONS WILL NOT BE TOLERATED, AND IS JUST CAUSE TO EVICT YOU FROM THE COMMUNITY OF SELKIRK LAKE MOBILE HOME PARK.
ACCEPTANCE OF RENT/LATE CHARGE AND DELINQUENT NOTICE
Rents are paid monthly. Rent is due on the first day of the month and must be paid on or before the fifth day of the month. A late/liquidation damage charge of thirty dollars ($30) will be charged to all residents whose rent is not received by management on or before the fifth day of the month. If residents choose to pay their rent with a personal check, a charge of Thirty dollars ($30) will be assessed against any check that is not honored for any reason. However, in the event a check is returned not paid for any reason or proceedings are instituted to enforce management's rights, only certified funds or a money order will be accepted for payment, for a period of six (6) months the first time. If proceedings are instituted a second time, no additional personal checks will be accepted from resident.
THREE OR MORE LATE PAYMENTS OF RENT AND OTHER CHARGES DURING ANY TWELVE (12) MONTH PERIOD IS "JUST CAUSE" TO EVICT YOU.
If the resident at any time shall default under the rules and regulations and/or lease agreement and if management shall institute an action or summary proceedings against the resident based on such default, then the resident will reimburse management as such can be allowed by statute for the expenses incurred by management and that so long as the resident shall be a tenant hereunder, the amount of such expenses shall be deemed to be additional rent, and shall be due from the resident to management on the first day of the month following the incurring of such respective expenses.
LIQUIDATED DAMAGES
In the contested action to terminate a tenancy for "JUST CAUSE", the prevailing party shall receive the following as "liquidated damages" as allowed under the Michigan Mobile Home Commission Act, MCLA 125.2328C, and the Michigan Summary Proceedings Act MCLA 600.5785: Five Hundred ($500.00) Dollars for an action in District Court, Three Hundred ($300.00) Dollars for each appellate level.
These "Liquidated Damages" are intended to reimburse the prevailing party for its expenses incurred in connection with the termination action and shall not be construed as a penalty. The payment of these "Liquidated Damages" shall not preclude either party from recovering their actual additional damages resulting from personal injury or physical damage to personal or real property caused by the other party or from recovering any unpaid rent or charges under the lease, if any is in effect, or there Rules and Regulations.
PARK RENT OF MAY 1, 2011
As of May 1, 2024, Lot Rent will be three hundred and ten dollars ($310.00).
No more than one family unit shall occupy all Mobile homes. A family unit consists of 2 married adults or both on the lease and 2 children (under age 18). Any deviations from this rule are subject to approval of park management and will result in additional rental costs of fifteen dollars ($15.00) per child and thirty dollars ($30.00) per month per adult. Persons that have not signed a current lease or that have not been approved for residency shall not occupy the mobile home park without the written consent of park management and their occupancy shall constitute a TRESPASS INTO
SELKIRK LAKE MOBILE HOME PARK.
MOBILE HOME INSTALLATION AND STANDARDS
All new installations and existing mobile homes must comply with all applicable local ordinances and state laws concerning placement, anchoring and setting up home prior to resident taking occupancy therein. All homes must be titled by the State of Michigan and this management must review proof of such. The resident shall be solely responsible for any damage to community property or that of other residents resulting from installation or removal of their mobile home.
To provide and maintain a clean and attractive community, all mobile homes are to meet the following accepted standards.
A. The siding and skirting of your mobile home must be clean and in good condition. The exterior is to be maintained in a neat and attractive manner at all times.
B. All windows and doors are to be in good condition. Broken windows are to be repaired immediately. No plastic is to be used for replacement.
C. Approved fire resistant skirting is required and must completely enclose the space beneath the home. Materials and color are to match or attractively accent the exterior. Residents shall skirt home within thirty (30) days of occupancy.
D. Repairs must be made within the time frame given by management in the notice to make repairs.
E. The area under the home is to be kept clean and no combustible material is to be present.
Decks must be constructed of treated wood and skirted. Awnings and additions are to be approved materials. All are to be maintained in good condition. Prior to installing a porch, deck, awning or addition, the resident must first submit a plan to park management for approval and then obtain any required building permits. Work to be completed within thirty (30 days).
G. Central air conditioner compressors must be placed on a cement pad at your cost. Window air conditional units must be securely braced to the home, not on stilts. Both must be attractively maintained.
H. HITCHES MUST BE REMOVED FROM THE MOBILE HOME UPON INSTALLATION.
I. Fences may not be installed around or upon the home site.
J. All homes are to contain at least one (1) fire extinguisher with a minimum 2A-l0-B-C rating and a smoke detector, both approved by a nationally recognized independent testing laboratory.
K. All homes having electric hot water heaters must have a check valve installed on the intake water line coming from the riser; this will prevent the heating element from becoming damaged should the park turn off the water for repairs
L. Nothing additional may be constructed on mobile home
M. All fire pits are to be kept cleaned out and grass cut around pit.
ANY VIOLATION OF THE PARK'S STANDARDS CONSTITUTES JUST CAUSE TO EVICT YOU FROM THE PARK.
RIGHTS TO SPACE AND TRANSEERABILITY
The right to occupy a home is not transferable with the sale or transfer of a home. Management reserves the right to require that all prospective residents complete a rental application and be approved. A personal interview and credit analysis is also required to the prospective purchaser prior to a change in the occupancy in the mobile home. Management must inspect the site and exterior of the home to confirm that it meets community standards. All items needing attention must be corrected prior to the management's final authorization of resale. One (1) 12" x 18" "For Sale" Sign is permitted on the inside of the front or side window. No signs of any kind shall be erected on the home site or the exterior of the home. THE RESIDENT PRIOR TO VACATING THE HOME UPON SALE MUST PAY ANY AND ALL PAST DUE RENT AND CHARGES. THERE WILL BE NO SUBLEASING OF MOBILE HOMES IN THIS COMMUNITY,
REMOVAL OF MOBILE HOMES
All rents and other applicable charges to management must be paid in full prior to moving the home from the community. Residents must also provide management with at least thirty (30) days written notice of their intent to remove their home. Any resident who should remove their home is responsible for removal of all trash, steps, and other discarded materials.
If management has to clean up lot after mobile home is removed will have a base charge of $100.00. This may be increased depending on costs of clean up.
Should the tenant's residency in the park be terminated in a court proceeding, and the tenant does not voluntarily remove his or her home within the time provided in the court's judgment, management shall move the home outside of the park limits at the tenant's expense. Tenant shall be responsible for removing the home from its new location, at tenant's own expense. Tenant shall reimburse the park for any and all costs paid by the park on behalf of the tenant in the removal of the tenant's mobile home.
IMPROVEMENTS AND ALTERATIONS
Residents shall make no alterations to the subject site without management's written consent. Management shall be provided with a sketch of any proposed improvements, i.e. porch, deck, carport, awning, shed and/pad, or other home additions, and resident shall be responsible for obtaining any building permits.
If any structure is deemed to be taxable by the municipality and is taxed as such, such taxes are the responsibility of the homeowner.
SITE MAINTENANCE
1. Residents must maintain all spaces in a clean, well-kept and attractive fashion. If space is neglected, Management may at its option take over such care and bill the resident for such services, to wit; Mowing and trimming site there will be a forty-dollar ($40) charge. Raking there will be a charge of forty dollar ($40) that includes getting rid of leaves and sticks.
2. The storage of junk, including unworkable cars, cars without current license plates, car parts or other appliances, etc., on or around the mobile home site is strictly prohibited. If Park Management believes that a resident's vehicle violates this provision, it shall post a notice of the violation on the vehicle windshield and provide a copy to resident within fourteen days from the posting of the notice on the vehicle the resident can bring the vehicle into compliance and provide proof to park management. If resident fails to do so, park management has the authority to have the vehicle towed to a facility at resident's expense.
3. No towels, rugs, wearing apparel, or other forms of laundry of any description may be hung outside the home. No clothesline or lines of any kind are permitted including umbrella poles.
4. Residents may, after supplying management with details and obtaining written approval plant trees and shrubs at theft home site. Said trees and shrubs become the property of the park when the resident vacates premises.
5. Trees may not be cut or trimmed without perrnission.Al1 fish cleanings and hunting remains must be buried in the woods same day. Residents will need to arrange other locations for banging carcasses of any kind.
6. No steps are allowed on your neighbor's side.
STORAGE SHED
A utility storage shed must be installed at the resident's expense. Resident is required to obtain written approval from management before installing or altering current structure in accordance to local, county, or state building codes. All shed colors require management approval. Sheds are to be kept in good repair at all times. All toys, bicycles, tricycles, lawn care equipment, folding lawn chairs, garden tools, ladders, etc. must be stored in a shed. Shed to be completed within thirty (30) days of occupancy, weather permitting.
TRASH REMOVAL
Trash is removed from the park on designated days. All trash must be secured in waterproof containers and placed in the park dumpster. No leaving trash outside of mobile home. PLEASE MAKE SURE THE COVERS ARE PLACED BACK ON TRE DUMPSTER. Critters get into dumpster if covers are not put back.
ALCOHOL CONSUMPTION/SUBSTANCE ABUSE
The consumption of alcoholic beverages is not permitted in the swimming beach or any common area within the community. Possession, use, and/or sale of drugs and! or other illegal substances will not be tolerated.
AUTOMOBILES
1. Parking of vehicles is not allowed on vacant sites, lawns and patios. Residents shall not park on neighbor's lot. Residents shall have only two (2) vehicles per household.
2. Guest parking. Guest may park on grass on the east side of dirt drive since our parking space is small.
3. Routine maintenance or minor repairs on vehicles may be carried out at the home site, i.e. change spark plugs, replace fan belts, or repair a flat tire. Major repair or maintenance projects such as repairing or replacing an exhaust system, oil change, or rebuilding an engine are not permitted. Vehicles also shall not be put on ramps or blocks for repairs.
4. PLEASE, PLEASE WATCH YOUR SPEED. Speed limit is five (5) niles per hour.
MOTORCYCLES AND RECREATIONAL VEHICLES
1. MOTORCYLCES are allowed to operate only for transportation in and out of Selkirk Lake Mobile Home Park.
2. The operation of trail bikes, mini-bikes, snowmobiles, and other vehicles of this nature are not allowed in the mobile home park Snowmobiles may use on established drives down to Selkirk Lake, but otherwise may not be used on Selkirk Lake property.
3. Driveway and paths are not for recreational use
4. We don't allow you to put up a dock, but if you would like to put a boat on a site there is a $500.00 charge per water craft per year.
TRESPASS
Management shall have the right of entry onto the home site for purposes of repair and replacement of utilities and protection of mobile home community at al reasonable times, but no in such a manner or at such time as to interfere unreasonably with the resident's quiet enjoyment of said leased premises. Management shall have no right of access to a mobile home, unless the resident's prior written consent has been obtained or to prevent eminent danger to the occupant(s) of the mobile home.
CONDUCT
It is requested that all residents, occupants, and their guests and invitees respect the rights of others to enjoy the quiet and peaceful use of this community. Excessively loud talking, abusive language, shouting, radio, television, stereos, and other disturbing noises are not permitted in this community.
REPEATED VIOLATION IS JUST CAUSE FOR EVICTION.
PERSONAL AND FIRE SAFETY
Management Is concerned with you and your family's well being. Our rules and regulations are the means of providing a happy and safe living environment for all.
1. All residents are advised to exercise proper care and safety to insure against accidents occurring in and around the mobile home, the home site and surrounding community Please not that you are responsible for the actions of your children, all occupants of your mobile home, guests and invitees.
2. Please take extra care when near the water. An adult should accompany children.
3. All homes are to be kept free from fire hazards. For your safety, do not store combustible materials, gas-powered lawn movers, gas cans, etc under your home or under/on your deck per state requirements.
4. B.B. guns, sling shots, bow and arrows, fireworks or firearms of any description are not allowed to be used on Selkirk Lake Mobile Home Part Property unless permission is granted by management. All decoys that are on Rohioff property must be taken care of by April 1St. of that year.
5. Residents shall furnish management the name, address and telephone number of a person to be notified in case of an emergency.
DISCLAIMER
Management disclaims responsibility for accidents or injuries to residents, their family members or guests that may occur within this community except for management's failure to perform a duty, or negligent performance of a duty imposed by law. Furthermore damaged or lost property resulting from fire, theft, wind, floods, or any other act of god which is beyond control of management is also specifically disclaimed.
SECURITY DEPOSIT
All residents must pay a security deposit equal to one month's rent prior to entry. into the mobile home park. The security deposit will be returned when a resident leaves if the home site is vacated in good condition in accordance with Public Act 348. Resident is required to leave a forwarding address.
PETS
The only pets allowed are 1 cat, fish and birds in a cage. These themselves are limited and need management approval beyond a quantity of one.

JUST CAUSE EVICTION
A violation of any of the park rules or regulations, as provided in these community rules and regulations, or their amendments, will constitute just cause to evict you from Selkirk Lake Mobile Home Park.
COMPLAINT ABOUT DOGS IN AND AROUND SELKIRK LAKE MOBILE HOME PARK
287-286a Complaint to justice of certain facts, issuance of summons; hearing, judgment; disobedience, penalty; costs; service of Officer, payment.
Sec. 26a On sworn complaint to any justice of the peace of the county that an one (1) of the following facts exist;
1. That after January tenth and before June fifteenth in each year any dog over four (4) months old is running at large, unaccompanied by its owner, or engaged in lawful hunting and not under the reasonable control of it's owner, without license attached to the collar on such dog;
2. That any dog at any time licensed or unlicensed, has destroyed property or habitually trespasses in a damaging way on property of persons other than the owner;
3. That any dog at any time, licensed or unlicensed, has attached or bitten a person;
4. That any dog shows vicious habits and molests passersby when lawfully on the public highway;
5. That any dog duly licensed and wearing license tag, is running at large contrary to the provisions of this act. Such justice of the peace shall issue summons similar to that provided in section twenty (20) of this act, to show cause why such dog should not be killed. Upon such hearing the justice may either order the dog killed, or may order him confined to the premises of the owner. If the owner disobeys such an order eh shall be liable to be punished under section twenty six (26) of this act. Costs as in a civil case shall be taxed against the owner of the dog, and collected by the county. The board of supervisors shall audit and pay claims for services of officers rendered under this section, unless the owner of the dog pays the same.
UNDER THE MOBILE HOME COMMISSION ACT YOU HAVE THE RIGHT TO FILE A VALID COMPLAINT THAT PERTAINS TO VIOLATIONS OF THAT ACT OR URLES RUBLISHED UNDER THE ACT. BEFORE A COMPLAINT CAN BE FILED UNDER THIS ACT OR THESE RULES, YOU MUST NOTIFY THE PARK, DEALER, BROKER, OR INSTALLER REPAIRER IN WRITING THAT A PROBLEM EXISTS. IF THEY DO NOT PROVED A REASONABLE RESPONSE WITHIN FIFTEEN (15) DAYS OF RECEIPT OF YOUR COMPLAINT, YOU MAY FILE A COMLAINT WITH THE MICHIGAN DEPARTMETN OF COMMERCE, CORPORATIONS AND SECURITIES BUREAU, MOBILE HOME DIVISION, P0 BOX 30222, LANSING, MICHIGAN 48909. PLASE NOTE THAT ONLY VIOLATIONS PERTAINING TO THE MOBILE HOME COMMISION ACT OR THE MOBILE HOME DIVISION CAN ACCEPT THSES RULES. COMPLAINTS PERTAINING TO MOBILE HOME PARK RENT COST DO NOT FALL UNDER THE AUTHORITY OF THE ACT.
